| Parents as Criminals? Ninth Circuit Court Gets It Right |

Ruling helps falsely accused parents California’s Child Protective Services (CPS) is a modern-day Gestapo. Thousands of innocent parents have been falsely accused of child abuse by an angry ex, a hostile neighbor or a liberal who wants to socially engineer Christian families. Reports are often based upon anonymous tips or frivolous accusations of spankings, sunburn or outright lies. But every parent who’s been accused remains part of the California Child Abuse Control Index (CACI)…even if the case file is closed or classified as inconclusive. These records are open and appear on background checks. 800,000 names are now in the database. Well, the Ninth Circuit Court of Appeals found the database unconstitutional, saying the list is “the reverse of the presumption of innocence in our criminal justice system.” The court ordered the state to enact greater procedural safeguards. The legislature, instead of raising taxes and imposing more unnecessary regulations, needs to enact legislation that will stop this abusive database. |
